Brian Drake is a staff attorney in the Boston office of Berman Tabacco.*  Brian focuses his practice on representing investors and consumers in cases involving unfair competition, consumer protection, securities and complex litigation. Brian also works to help analyze and submit whistleblower submissions before the U.S. Securities and Exchange Commission.

Earlier in his career, Brian served as a staff attorney at a number of prominent law firms in Washington, D.C. and Boston, where he served on the litigation teams in several complex antitrust and tax cases.

Experience

  • Member of the firm’s litigation team representing a class of EpiPen purchasers alleging that their Pharmacy Benefit Managers (PBMs) unlawfully retained manufacturer rebates and other monies at the expense of the purchasers.
  • Member of the litigation teams bringing bid-rigging/market manipulation cases alleging that several major banks colluded to manipulate numerous financial benchmark rates, including the Yen Libor, EuroYen Tibor and Euribor.
  • Member of the investigative team evaluating and analyzing potential new actions and whistleblower submissions.
  • Served as a member of the firm’s litigation team for In re BP p.l.c. Securities Litigation, No. 10-md-2185 (S.D. Tex.), a major securities class action stemming from the explosion of the Deepwater Horizon oil rig.
  • Prior to Berman Tabacco, worked as staff attorney at a number of prominent law firms in Washington, D.C. and Boston, where he developed a broad range of expertise, primarily in the areas of anti-trust and tax litigation.
