San Francisco Managing Partner Nicole Lavallee was quoted recently by the National Post of Toronto in an article about the potential impact an impending U.S. Supreme Court ruling could have on Canada’s legal landscape.
In the May 28 article, reporter Drew Hasselback asks lawyers if there could be an uptick in Canadian litigation if the Supreme Court eliminates the so-called “fraud on the market” rule that underpins many U.S. securities class actions. The U.S. high court is expected to issue its opinion by the end of June in the case at issue, Erica P. John Fund Inc. v. Halliburton Co.. In the article, Ms. Lavallee says she doesn’t see a “huge” number of U.S. plaintiffs flocking to Canada for justice, though she says they have been “looking at all options” ever since another Supreme Court ruling in 2010 eliminated federal securities lawsuits for losses on stock purchased outside the United States. Ms. Lavallee, a Montreal native who pursued her legal training in Ontario and Quebec, was the only U.S. attorney quoted in the article.
