Berman Tabacco served as a member of the executive committee for the proposed class of direct purchasers of optical disk drives (“ODDs”), in this multidistrict litigation filed in the U.S. District Court for the Northern District of California, representing plaintiff Seneca Data Distributors, Inc. The lawsuit alleged that defendants, manufacturers of ODDs including Hitachi, LG, Toshiba, Sony, and Samsung, participated in a conspiracy to fix, raise, maintain and stabilize the price of ODDs sold in the United States from January 1, 2004 until at least January 1, 2010 through price-fixing (including acts of bid-rigging) and market allocation. It further alleged that, as a result of defendants’ unlawful conduct, plaintiffs paid higher prices for ODDs and devices containing ODDs, such as notebook computers, than they would have paid in a competitive market. The case settled for a total of $74.9 million.
