Berman Tabacco represented the Oklahoma Firefighters Pension and Retirement System in this action alleging that the El Paso board of directors breached its fiduciary duties by agreeing to a less-than-value-maximizing merger transaction between El Paso and Kinder Morgan, Inc. (“KMI”), and that the board’s financial advisor, Goldman Sachs & Co., and KMI aided and abetted the board’s breaches. Through the litigation, plaintiffs obtained a $110 million monetary recovery for El Paso’s shareholders.
